These Terms govern your use of the Plumbline Trading Suite (the "Software") and the plumblinetrading.com website (the "Site"). By accessing, downloading, installing, or using the Software or Site, you agree to be bound by these Terms. If you do not agree, do not use the Software or Site.
Plumbline Trading Suite is an educational and research tool. Nothing on this Site or produced by the Software constitutes financial, investment, trading, tax, or legal advice, or a recommendation to buy, sell, or hold any security, contract, or other financial instrument.
The statistical tests, simulations, and reports produced by the Software describe properties of a historical trade log. They do not predict future results. Past performance — simulated or actual — is not indicative of future performance. Trading futures, options, and other leveraged products involves substantial risk of loss and is not suitable for every investor. You can lose more than your initial deposit.
You are solely responsible for your trading decisions and for verifying the correctness, applicability, and legality of any output from the Software in your jurisdiction. Consult a licensed financial professional before making investment decisions. Use of the Software is at your own risk.
This is a personal, proprietary research tool. It gives you no advice. It comes with no warranty. It runs entirely in your browser and collects no data. You may use it for your own trading research; you may not resell, re-host, or reverse-engineer it. Everything you do with it — and every trading decision you make based on it — is your responsibility. The rest of this page is the same idea in more precise language.

The author of the Software (Caleb Tharp) is not a registered investment adviser, broker-dealer, commodity trading adviser, or licensed financial professional. Any output produced by the Software is a statistical description of historical data you provide to it — nothing more.
Past performance — whether simulated, hypothetical, or actual — is not indicative of future results. Backtests, walk-forward analyses, Monte Carlo simulations, and portfolio-fit reports produced by the Software are inferences from historical data. They describe how a strategy would have behaved on that specific data. They do not predict how it will behave in the future, in different market regimes, under different execution conditions, or on live capital.
Hypothetical or simulated performance results have inherent limitations. Simulated results do not represent actual trading and cannot fully account for the impact of market factors such as liquidity, slippage, execution latency, order rejection, and price impact. Simulated programs are also generally designed with the benefit of hindsight. No representation is made that any account will or is likely to achieve profits or losses similar to those shown.
Trading futures, options, foreign exchange, cryptocurrencies, and other leveraged financial instruments involves substantial risk of loss and is not suitable for every investor. You should carefully consider whether such trading is appropriate for you in light of your financial condition, experience, and risk tolerance.
You can lose all of your invested capital, and in leveraged accounts you can lose more than your initial deposit. Prop firm evaluation accounts, funded accounts, and simulated accounts each carry their own distinct rules, risks, and cost structures that the Software cannot fully model. Rule changes by prop firms, brokers, exchanges, or regulators can invalidate assumptions used by the Software at any time.
Stage IV simulations of prop firm rulesets are checks, not shortcuts. They do not replace reading and understanding the specific rulebook of any firm you evaluate with or trade under. Firm rules change; the Software's shipped ruleset templates may lag those changes.
The Software and Site are provided "as is" and "as available," without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, Caleb Tharp and the Plumbline Trading Suite project disclaim all warranties, including but not limited to:
No advice or information, whether oral or written, obtained from the Software or Site creates any warranty not expressly stated in these Terms.
You assume all risk arising from your use of the Software and Site. To the maximum extent permitted by applicable law, in no event shall Caleb Tharp, the Plumbline Trading Suite project, or any contributor be liable for any:

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you. In such jurisdictions, liability is limited to the maximum extent permitted by law. In no event shall total aggregate liability exceed one hundred U.S. dollars (US $100) or the amount you paid (if any) to use the Software in the twelve months preceding the claim, whichever is greater.

The Software and Site — including all source code, compiled code, documentation, methodology writeups, statistical implementations, ruleset templates, benchmark data bundles, visual design, branding, logos, typography, copy, and any other materials — are the proprietary property of Caleb Tharp. All rights are reserved.
The Software is proprietary software. It is not open source. No open-source license (MIT, Apache, GPL, or otherwise) is granted, either expressly or by implication. Except for the limited license granted in §8 Acceptable Use, no rights are transferred or licensed to you under these Terms.

Subject to your ongoing compliance with these Terms, Caleb Tharp grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Software and Site solely for:
You may not, without a separate written commercial license from Caleb Tharp:
Commercial licensing tiers (including, without limitation, distribution via marketplaces such as Whop and other future paid distribution or subscription models) may be offered separately. Any such commercial license will be governed by a separate agreement between you and Caleb Tharp and, where inconsistent with these Terms, that separate agreement will control for the scope it covers. In the absence of such a separate written agreement, only the personal, non-commercial license above applies.
Caleb Tharp may suspend or terminate your license at any time, with or without notice, if you violate these Terms or if continued provision of the Software becomes impracticable. Upon termination, you must cease all use of the Software and destroy any local copies in your possession. Sections that by their nature should survive termination (including §4 No Warranty, §5 Limitation of Liability, §6 User Responsibility, §7 Intellectual Property, §11 Governing Law, and this sentence) will survive.
The Plumbline Trading Suite is designed as a local-first, zero-telemetry tool. As shipped:
The Site is hosted on infrastructure operated by third parties (currently Cloudflare Workers). Those providers may independently log network-level information such as IP addresses, request headers, and edge-cache metrics for security, abuse-prevention, and operational purposes, subject to their own policies. Caleb Tharp does not receive personally identifying analytics from that logging and does not combine it with any user profile.
If the data-handling design of the Software changes in a material way (for example, by introducing optional cloud sync, accounts, or analytics), the change will be reflected in an updated version of these Terms and, where practicable, called out on the Site.
The Software integrates with, or references, third-party platforms and data sources that are outside Caleb Tharp's control, including but not limited to:
Caleb Tharp does not control and is not responsible for the availability, accuracy, terms, pricing, rulebooks, or conduct of any third-party platform, service, or data source. Your use of any third-party service is governed by the terms of that service. Rule changes, data revisions, or service discontinuations by any third party may cause the Software's output to become stale, inaccurate, or unusable at any time and without notice.
These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States of America, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to these Terms, the Software, or the Site shall be brought exclusively in the state or federal courts located in Jefferson County, Alabama, and you consent to the personal jurisdiction and venue of those courts. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Failure to enforce any provision is not a waiver of the right to enforce it later.
These Terms constitute the entire agreement between you and Caleb Tharp regarding the Software and Site and supersede any prior agreements on the same subject matter, except for any separately signed commercial license agreement, which will control within its stated scope.
Caleb Tharp may update these Terms from time to time. When Terms change, the Effective date at the top of this page will be updated and the version number will be incremented. Material changes will be reflected in the visible copy of these Terms on the Site.
Continued use of the Software or Site after an update constitutes acceptance of the updated Terms. If you do not agree to an update, your only remedy is to stop using the Software and Site. Historical versions of these Terms are not archived on the Site by default; if you rely on a specific version, save a local copy.
